NOT PRESENTING OR ARRIVING LATE AT THE TIME INDICATED AT THE MEETING POINT CONCLUDES LOSS OF THE RIGHT TO VISIT AND NON-REFUNDING OF THE SERVICE AMOUNT.
1. IDENTIFICATION OF THE ORGANIZER AND PURPOSE
This contract regulates the acquisition of tourist services through the platform BOOKYOURTOUR.INFO, managed by ALHAMBRA VALPARAISO OCIO Y CULTURA S.L. (hereinafter, "The Agency"), with NIF B18609719 and registered address at C/ San Antón 72, 1º Izq, Local 39, 18005 Granada, Spain.
The Agency acts as the organizer and seller of the services offered, assuming the corresponding legal obligations according to the current tourism regulations, except for tourist services not organized by it.
Making a reservation implies full acceptance of these conditions.
2. CANCELLATION AND MODIFICATION POLICY
Cancellation and modification of the reservation must be requested in writing from your client area.
A. ALHAMBRA AND GENERALIFE VISITS (Nominal Tickets)
A.1. Availability Condition:
The reservation made is subject to the normal availability of tickets to the monument, whose management is external to the company. If such usual availability is exceptionally not met, we will contact you as soon as possible to offer an alternative date or, at your choice, proceed to the immediate refund of the amount paid.
A.2. Specific Operations and Timetables:
Due to the shift assignment by the Patronato (Trustee Board), the exact access time will be confirmed in the voucher or final communication, respecting the following time slots:
- MORNING Visits: The client may be scheduled to start the visit in the slot between 8:15h and 12:00h. The visit lasts approximately 3 hours.
- AFTERNOON Visits: The visit will start at approximately 14:00h. The visit lasts approximately 3 hours.
- o Summer Timetable (April 1st to October 14th): The client may be scheduled to start the visit between 14:00h and 16:30h. The visit lasts approximately 3 hours.
A.3. Access Regulations and Documentation (MANDATORY):
- Documentation: For Alhambra visits, it is MANDATORY to bring your original identification (ID/Passport) on the day of the visit. If the provided data does not match the visitor's data, the Alhambra may deny access to the monument.
- Ticket safekeeping: You must keep the ticket throughout the itinerary. In case of loss, you will not be able to continue the visit.
A.4. Cancellation Policy (Patronato Regulations):
Due to the strict Patronato regulations regarding nominality:
- Private Visits: The ticket amount and its management fee are not refundable. The portion corresponding to the guide service will not be refunded if cancelled less than 72 hours in advance.
- Group / Regular Visits: They do not allow cancellation, modification, or refund once confirmed, due to the nominal nature of the monument ticket.
B. REST OF SERVICES / VISITS (General)
For the rest of the visits not specified in the previous sections:
- Cancellations with more than 72 hours notice: Full refund minus €8 for management fees.
- Cancellations with less than 72 hours: No refund.
- Groups of more than 8 people: Must notify changes or cancellations at least 7 days in advance.
3. RESOLUTORY CONDITION: MINIMUM GROUP OF 12 PARTICIPANTS
(Clause applicable to tours and group visits subject to quota)
3.1. The realization of certain tourist visits and excursions offered on this platform is conditioned on the enrollment of a minimum number of 12 participants.
3.2. If this number is not reached, The Agency reserves the right to terminate the contract and cancel the activity without penalty, notifying the client at least 48 hours before the scheduled start date and time (for services lasting less than 2 days), in accordance with article 160.3 of RDL 1/2007.
3.3. In this case, the client will have the right to choose between:
- The total refund of the amounts paid, which will be made within a maximum period of 5 business days.
- A change of date or an alternative activity of equivalent quality. If the alternative is of lower quality, the difference will be refunded.
- No additional claim for damages will proceed if the legal notice period is met.
4. RIGHT OF WITHDRAWAL
In accordance with article 103.l) of Royal Legislative Decree 1/2007, the consumer is informed that the right of withdrawal (no-fault return within 14 days) IS NOT APPLICABLE to contracts for the provision of leisure services if the contract provides for a specific execution date or period. Therefore, the Cancellation Policy stipulated in clauses 2 and 3 governs.
5. EXECUTION OF THE SERVICE AND LIABILITY
- Confirmation voucher: It is essential to show the confirmation voucher (printed or on your mobile) to our staff on the day of the visit. This voucher is valid as proof of payment.
- Punctuality: It is the client's responsibility to arrive at the meeting point at the indicated time. Non-presentation (no show) or delay entails the loss of the service and the amount paid.
- Documentation: The Agency is not responsible if access is denied due to data discrepancy or lack of documentation attributable to the client.
- Modifications due to force majeure: The Agency may modify itineraries or substitute monuments for others of similar category in the event of circumstances of force majeure (adverse weather, unexpected closure, strikes, security). In the event of total cancellation due to force majeure, an alternative date or refund will be offered, without additional compensation.
- Liability: The Agency is not responsible for the loss of personal belongings due to client negligence, nor for damages suffered due to imprudence or non-compliance with the guide's instructions.
6. DATA PROTECTION
The personal data provided will be processed by AVOC S.L. for the management of the reservation.
The client is informed and accepts that their identifying data (Name, ID) will be mandatorily communicated to the Alhambra and Generalife Patronato or other monument managing entities for the issuance of nominal tickets and security control. 7. LEGISLATION AND JURISDICTION
These conditions are governed by Spanish law.
For the resolution of conflicts with consumers, the parties submit to the jurisdiction of the Courts and Tribunals corresponding to the consumer's domicile, or those determined by the current consumer and user protection regulations.
